Requesting Disclosure Documents

Disclosure Documents are required in the sale of any home. Once your home is for sale, you must submit your request for Disclosure Documents in writing. To do so, please submit your written request to  [email protected]. Only homeowners can initiate the request as we can only disclose to an owner or their authorized agent and need the homeowner to confirm that a realtor is their authorized agent.  If you are the seller's realtor or agent and believe that the seller cannot initiate the request, you will need to provide a copy of: the ratified real estate contract for purchase and sale; the broker's agreement for listing of the property; or a power of attorney listing the agent before we can work directly with you.  In that request, please include the following information:

  • Your full name and whether you, as the homeowner, will handle further questions about the request and receive documents or whether you want your realtor to receive documents as your authorized agent.  If you want your realtor to act as your authorized agent in receiving the documents, provide a name and contact number for the listing realtor.
  • The full address of the property
  • The date the property was listed on the market and whether or not a contract is pending on the home.
  • Whether you want hard copy or an electronic copy.  An electronic copy is cheaper, generally faster, and saves you the cost of requesting and paying for extra copies.  

Be sure your home is actually in our HOA to avoid delays!  Our website landing page lists the streets that are within our HOA.  There is another nearby HOA with a similar name and each year we receive multiple communications from people who don't actually live within the HOA.  

In order to avoid claims that the HOA has improperly interfered with a transaction, the HOA will no longer accept disclosure package requests from anyone other than the seller (the homeowner) (or their agent if the process above is followed) or communicate with parties other than the seller or their authorized agent.  Once a homeowner has initiated a disclosure documentation request and designated a realtor as indicated in the first bullet point above, the HOA will include the agent in further communications. All inquiries from the purchaser or purchaser's agent will be referred to the seller or their agent.  

We will accept written or emailed requests for disclosure packages.  In the very near future, a homeowner can submit a request via the SWHOA website using a form (not yet completed).  

The request for Disclosure Documents must be made at least two weeks in advance. Any request with less than two weeks notice may not be successful. Fees for the preparation of the materials are as follows and the check should be written to HOA of Shaker Woods.

$146  for documents in paper format, $29.00 for additional hard copy.

$125  for documents in electronic format.

$100  for AECC inspection, waived if no violations found.

$50  for AECC re-inspection fee.

$25  for refinance documents, beyond account statement request.

$58  for package updates within one year, plus the re-inspection fee.

$58  for account set up fee for new occupant collected at closing.



Requesting disclosure-type information associated with a refinance:

All communications must come from the homeowner and not from the mortgage broker.  There is no fee if the only information needed is confirmation of dues amount and payment status.  Any other forms will incur a $25 fee unless a full disclosure package is required.  A full disclosure package incurs the normal disclosure fees.
